Incedent Reporting
Incident reporting is a resource for people concerned about the well-being of individuals with mental retardation and developmental disabilities. Incident reporting not only keeps the agency informed, but in some cases reports also are filed on a state level.
This office conducts reviews of all reports of abuse, neglect, or major unusual incidents involving persons with developmental disabilities. This office also monitors responses to incidents. Office staff members work with local law enforcement officials to support investigations and prosecution of individuals who are suspected of abuse and/or neglect of people with developmental disabilities. The office also works closely with Butler County Children Services regarding allegations of abuse and/or neglect of children up to the age of 21.

What To Report?
It is important to report any suspicions that an individual with mental retardation and/or developmental disabilities is being mistreated. These reports include suspected abuse, neglect or any major unusual incidents (MUI's).

What Is Abuse?
Abuse is classified in three ways: physical, sexual and deprivation of real or personal property.
- Physical abuse is one person causing physical harm to another.
- Sexual abuse is unwanted touching, non-consensual sexual acts.
- Verbal abuse is using words or gestures to threaten, coerce, intimidate, harass or humiliate another individual
- Mental abuse is harassing, humiliating and invoking fear to another individual.
- Violation of Rights is any incident where basic rights are ignored.
- Exploitation is using another individual's money or belongings for personal benefit, profit or gain.
What Is Neglect?
Neglect is failing to provide treatment, care, goods, supervision, or services necessary to maintain health and safety.

Major Unusual Incidents Definitions
A Major Unusual Incident (MUI) is the alleged, suspected or actual occurrence of an incident when there is reason to believe the health or safety of an individual may be adversely affected. MUIs include the following:
- Physical Abuse is the use of physical force that can reasonably be expected to result in physical harm. Such force may include, but is not limited to, hitting, slapping, pushing or throwing objects at an individual.
- Sexual Abuse is unlawful sexual conduct or contact, public indecency, importuning, and voyeurism.
- Prohibited Sexual Relations is when an MRDD worker is engaged in consensual sexual conduct or contact with an individual whom they are paid to provide care for.
- Verbal Abuse is the purposeful use of words or gestures to threaten, coerce, intimidate, harass, or humiliate an individual.
- Neglect is failing to provide treatment, care, goods, supervision, or services necessary to maintain the health and safety of the individual.
- Misappropriation is depriving, defrauding or otherwise obtaining the real or personal property of an individual.
- Exploitation is the improper act of using an individual or their resources for monetary or personal benefit, profit, or gain.
- The Death of an individual.
- An Attempted Suicide that results in emergency room treatment, in-patient observation or hospital admission.
- Any Injury of Known origin that requires immobilization, casting, five or more sutures or the equivalent, second or third degree burns, dental injuries or Unknown origin which requires treatment only a physician, physician’s assistant, or nurse practitioner can provide.
- A Medical Emergency occurs when emergency medical intervention is required to save an individual’s life (i.e. Heimlich maneuver, CPR, rescue breathing, IV fluids for dehydration.)
- Any injury or illness that results in the Unscheduled Hospitalization of the individual.
- An act involving an individual with mental retardation and/or other developmental disabilities involving Law Enforcement resulting in the arrest, incarceration or charges against the individual.
- A Missing Individual MUI occurs when an individual cannot be located within a specified period of time, cannot be located after specified actions are taken, cannot be located in a search of the immediate area, circumstances indicate the individual may be in immediate jeopardy or law enforcement has been called to assist in the search of the individual
- An Unapproved Behavior Support is the use of any aversive strategy or intervention implemented without approval by the human rights committee, behavior support committee, or without informed consent.
- Peer to Peer Acts occur when an act of physical abuse with intent to harm; verbal abuse with intent to intimidate, harass, or humiliate; sexual abuse; exploitation; or intentional misappropriation is committed by one individual with MRDD against another individual with MRDD.
- Failure to Report is when a person, who is required to report alleged, suspected or actual abuse, neglect or misappropriation, has reason to believe an individual has suffered or faces substantial risk of suffering abuse, neglect, or misappropriation, and that person does not immediately report such information to a law enforcement agency or the county board.
If a worker or volunteer in MRDD services observes or has reason to believe that a MUI involving an individual with mental retardation and/or other developmental disabilities has occurred, that person must report the occurrence to the Office of Incident Review. Such a report must be made within 1 hour of their knowledge of the occurrence and a written report about the occurrence must be made to the ODMRDD Incident Tracking System by the Office of Incident Review by 3 p.m. the next working day.
- Any Rights Code Violation pursuant to Ohio Revised Code Section 5123.62 effecting the health and safety of the individual.
What is An Unusual Incident (UI)?
An Unusual Incident (UI) is an event or occurrence not consistent with routine operation, policies, procedures or the care and habilitation plan of an individual with mental retardation and/or other developmental disabilities, but does not meet the criteria of a MUI.
All licensed or certified service providers shall record the occurrence of UI’s and make such records available to the Butler County Board of MRDD upon request. When an UI occurs while an individual is receiving services from the Butler County Board of MRDD Programs, the county board shall record the incident and make the records available upon request to the individual or legal guardian.
UI’s are recorded using the internal procedures of the agency with which the observing worker is affiliated. UI’s need not be reported to the Office of Incident Review.
